Please read these Terms of Service (“Terms”) carefully before using Mythora (“we,” “us,” or “our”) located at mythora.app. By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the service.

1. Acceptance of Terms

By creating an account or using Mythora in any way, you represent that you are at least 13 years of age (or 16 if you reside in the European Economic Area), that you have the legal capacity to enter into a binding agreement, and that you accept and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Mythora is an AI-powered persistent world platform that allows users to create, explore, and interact within shared fantasy worlds generated and maintained by artificial intelligence. The service includes:

  • World creation tools powered by generative AI.
  • A map-based interface for exploration and interaction.
  • Asynchronous multiplayer features enabling shared world experiences.
  • Subscription plans providing access to premium features and higher usage limits.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must provide accurate, current, and complete information during registration and keep it up to date.
  • You may not share your account or allow others to access the service through your credentials.
  • You must notify us immediately at support@mythora.app of any unauthorized use of your account.
  • We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.

4. User Content & AI-Generated Content

Your Content

You retain ownership of original content you submit (world seeds, prompts, text inputs). By submitting content, you grant Mythora a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content solely for the purpose of operating and improving the service.

AI-Generated Content

Content generated by our AI systems in response to your inputs (“AI Content”) is provided to you under a limited, non-exclusive license for personal, non-commercial use unless your subscription plan specifies otherwise. We make no warranty that AI Content is original or free from third-party rights. You are solely responsible for evaluating AI Content before any commercial use.

Content Standards

You agree that all content you submit will not be unlawful, harmful, defamatory, obscene, or infringing of third-party rights. We reserve the right to remove any content that violates these standards.

5. Prohibited Conduct

You agree not to:

  • Use the service for any unlawful purpose or in violation of these Terms.
  • Attempt to circumvent usage limits, rate limits, or subscription restrictions.
  • Use automated scripts, bots, or scraping tools to access the service without prior written consent.
  • Submit prompts designed to generate illegal, hateful, sexually explicit (involving minors), or otherwise harmful content.
  • Attempt to reverse engineer, decompile, or extract the underlying AI models or proprietary algorithms.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the service or its underlying infrastructure.
  • Use the service to train competing AI models or datasets without our explicit written permission.

Violation of this section may result in immediate account termination and, where appropriate, legal action.

6. Intellectual Property

The Mythora name, logo, platform design, and underlying technology are owned by Mythora and protected by intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding without our prior written consent.

You acknowledge that the service, including its AI systems, software, and infrastructure, is the exclusive property of Mythora and its licensors. You may not copy, modify, distribute, sell, or lease any part of the service.

7. Subscriptions & Payments

  • Certain features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis as selected.
  • All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.
  • We reserve the right to change our pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
  • Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for all applicable fees.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the service will be uninterrupted or error-free; (b) the results obtained from use of the service will be accurate or reliable; (c) AI-generated content will be appropriate, accurate, or suitable for any particular purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYTHORA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO MYTHORA IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mythora and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the service at our sole discretion, at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, harmful behavior, or extended inactivity.

Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date and notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the service.
